Hon'ble Shri Justice Goutam Bhaduri Order 20/06/2017 1.

Perusal of the petition would show that clarification of the order has been sought for by the applicants which is passed in Criminal Appeal No.994/1997 wherein fine of Rs.20,000/- has been directed to be paid to the victim.

Learned counsel submits that learned Additional Sessions Judge (FTC) Raigarh has directed for deposit of Rs.20,000/- by each of the accused which is to be paid to the victim which is not order of the division bench dated 12/02/2013, therefore order dated 12/02/2013 may be clarified.

Perusal of the order dated 12/02/2013 passed in Criminal Appeal

No.994/1997 would show that it is order passed by division bench of this court, therefore clarification of order can only be made by the division bench.

At this juncture, learned counsel for the applicants seeks permission of this court to withdraw this petition with liberty to move appropriate petition before appropriate bench for clarification of the order dated 12/02/2013 passed in Criminal Appeal No.994/1997. 5.

Consequently, the petition is dismissed as withdrawn with aforesaid liberty.
