The applicant has been arrested in connection with Crime No.306 of 2020 registered at Police Station- Kotwali, Janjgir, District Janjgir-Champa (CG) for the alleged commission of offence under Section 408, 409, 418, 420, 120-B of IPC. 2.

This Court had earlier rejected the bail application of the present applicant taking into consideration the role alleged to have been played by present applicant in the alleged fraud and cheating. Till date, charges have also not been framed against the present applicant and he has remained in jail since 11.08.2020. The bail application was earlier considered and rejected on merits six months before. Since than no progress has been made in the trial mainly obviously for the reason that trials are not taking place. Taking into consideration the totality of the circumstances at this stage, this Court considered that applicant should be granted bail with appropriate condition only on the ground of delay in trial and taking into consideration the nature of allegation against him and also other developments as stated herein above. Presence of the applicant may be secured by appropriate conditions. Therefore, the application is allowed only on the ground of delay in trial. 3.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- along with two local sureties for the like

-2amount to the satisfaction of the concerned trial Court with following further conditions:

(i) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial; and (ii) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. Certified copy as per rules.
