1. This writ petition (criminal) has been preferred by the petitioner against the order of externment passed by learned District Magistrate, Janjgir-Champa on 30/08/2018.

2. Learned Counsel for the petitioner submits that the order of externment dated 30/08/2018 passed against the petitioner is appealable under Section 9 of the Madhya Pradesh/Chattisgarh Rajya Suraksha Adhiniyam, 1990 and that he may be allowed to prefer an appeal.

3. I have heard learned counsel for the parties, considered their submissions and went through the records with utmost circumspection.

4. Be that as it may, the petitioner is at liberty to prefer an appeal within 15 days from today and if such an appeal is preferred by him, the appellate authority will decide and consider the appeal along with the application for condonation of delay within three months from the date of receipt of the copy of this order.

5. With the aforesaid direction, this writ petition (criminal) stands disposed of. No cost(s).
