2. Collector, Bastar District Bastar Chhattisgarh.
3. District Ayurved Adhikari, Bastar District Bastar Chhattisgarh. ---- Respondents For Petitioner :
Shri Uttam Pandey, Advocate For Respondent/State :
Shri Satish Gupta, GA Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 04/08/2017 Heard.
2.
By this petition, the petitioner is challenging suspension order dated 27-07-2017 (Annexure P/1) on the ground that he is being harassed. The petitioner made a complaint against one Gayatri Shukla alleging that she is involved in corruption. It is because of this allegation, the petitioner has been victimized and by malafide order, placed under suspension at the fag end of his service as he going to retire on 31-08-2017.
3.
In the absence of there being any ground of lack of jurisdiction, violation of principles of natural justice or ground of malice on the part of the respondent authority while issuing the order of suspension, this Court would not ordinarily interfere with the order of suspension, when the petitioner has a remedy of statutory appeal. There is no allegation of personal malice leveled against the Officer, who has passed the order of
suspension. Though, the petitioner may have other grounds on merits, but that cannot be made a basis to entertain the petition, when extra-ordinary grounds are not made out.
4.
With the liberty to file an appeal, this petition is dismissed. SD/- (Manindra Mohan Shrivastava) Judge Tumane
