1. The Petitioner is son of Late Duryodhan Mandavi who was working with the respondents, died on harness on 26.12.2009. The grievance of the Petitioner is that though the deceased employee died in the year 2009 but till date the dues payable to the family members on the death of the deceased employee has not been released.

The Writ Petition has been filed seeking for a direction to the Respondents for release of the same.

Learned Counsel for the State submits that they have received a telephonic instruction from the concerned department where the deceased employee was working that the case is already in process in respect of the entitlement of the Petitoiner and the same has been forwarded to the ofÏce of the Respondent No. 2, the Joint Director, Treasury Accounts and Pension, Kanker for passing appropriate orders.

3. On the basis of this limited submission made by the State Counsel, this Court does not intend to keep this matter pending any further.

4. Accordingly, the present Writ Petition stands disposed of with a direction to the Respondents No. 4 to ensure the recommendation which has been made by him to Respondent No.2 is processed at the earliest. The Respondent No.2 in turn is directed to ensure so far as the claim of the settlement of dues in respect of the deceased employee is concerned be finalised and decided within a period of 3 months form the date of receipt of the certified copy of this order.

5. Needless to mention that if Respondent No.2 finds the Petitioner is entitled for the monetary benefits the same shall be released to the Petitioner forthwith. In case if the Petitioner is not entitled for any monetary benefits the

same shall be intimated to the Petitioner giving reasons as to why he is not entitled for the release of any dues.

6. With the aforesaid observation the present Writ Petition stands disposed of.
