1. The present contempt petition has been filed alleging willful non compliance of order dated 01.03.2017 passed by this court in Writ Petition (S) No.185 of 2017. Vide the said order, this court had directed the respondents to consider the case of the petitioner for grant of compassionate appointment.
2. The respondent has entered appearance and filed reply wherein it has been stated that they have processed the case of the petitioner and is awaiting approval/consent of the General Administration Department of the State for which a letter dated 25.09.2017 has already been sent.
3. This aspect is not disputed by the counsel for the petitioner.
4. Considering the fact that the respondent has made a positive response to the directions given by this court on 01.03.2017 which is explicit from the letter dated 25.09.2017, this court is of the opinion that as of now no contempt is made out against the present respondent. However, in the event if the authorities in the General Administration Department do not act upon the directives given by this court, the petitioner shall be at liberty to avail the appropriate remedy available to him.
5. With the aforesaid observations, the contempt petition stands disposed of.
