1. The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.26/2018 registered in Police Station Gandhai, District Rajnandgaon C.G. for the offence punishable under Section 406 of the I.P.C.
2. Complainant had handed over 42 buffaloes for performing grazing work to the applicant, however, later on, after sometime, applicant did not perform work of grazing and let lose the buffaloes in the forest area. The applicant could
MCRC No. 4333 of 2021 recover and bring back 17 buffaloes and the remaining 25 were not traceable, therefore, according to complainant the applicant has sold 25 buffaloes in the market valued at Rs.6,25,000/-
3. Learned State counsel would oppose the prayer for grant of bail.
4. Considering that offence is triable by JMFC as also for the fact that applicant is in jail since 07.8.2020 i.e., for about 1 year and the charge-sheet has already been filed, I am inclined to release the applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
