1. Heard.

2. The applicants have preferred the first bail application under Section 439 of the Cr.P.C., as they are arrested in connection with Crime No.336/2021, registered at Police Station - Khamtrai, District - Raipur (C.G.) for the offence punishable under Section 20-B of the Narcotic Drugs and Psychotropic Substance Act, 1985.

3. Both the applicants were found in joint illicit possession of 4.400 Kilograms of contraband Ganja.

4. Learned State counsel would oppose the prayer for grant of bail and would submit that both the applicants have previous criminal antecedents. On query being made, he fairly submits that none of the previous antecedents involves commission of offence under N.D.P.S. Act.

5. Considering that the applicants are in jail since 09-06-2021 i.e. for more than two and a half months and the charge sheet has already been filed, I am inclined to release both the applicants on bail.

6. Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
