Hon'ble Shri Justice P. Sam Koshy Order on Board 10/08/2017 1.

Challenge in the Writ Petition is to the order dated 21/03/2016 Annexure-P1 whereby petitioner who was working as a Rojgar Sahayak under the Gram Panchayat, BadgaonKala, District Koria has been removed from service.

2.

The Counsel for the Respondent opposes the petition on the ground that there is an alternative remedy of preferring an appeal to the Collector/Appellate Authority in accordance with the provision of National Rural Employment Guarantee Scheme.

3.

In view of the fact that there is alternative remedy available to the petitioner, the present Writ Petition is disposed off giving liberty to the petitioner to approach the Collector/Appellate Authority challenging the impugned order dated 21/03/2016. 4.

In the event if the petitioner files an appeal to the Collector/Appellate Authority, the same should be entertained and decided on merits ignoring the limitation part in the filing of the appeal if any. 5.

The Writ Petition stands disposed off.
