This is repeat bail application. Earlier one was dismissed as withdrawn on 13.12.2017 with liberty to revive the same after the material witnesses are examined.

The repeat bail application has been filed after the victim has been examined before the court on 01.12.2018. A perusal of statement of victim would reveal that it is not a case where the victim has turned hostile or not supported the case of the prosecution.

In view of the above, this court is of the opinion that the present is not a fit case for grant of bail at this juncture. Considering the fact that the victim has already been examined, it is expected the trial court would ensure that the remaining witnesses are also examined at the earliest and try to conclude the trial as expeditiously as possible.
