Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 31/01/2017 In this case, State counsel was granted time to file return on earlier occasion more than once but no reply has come. Heard.
Learned counsel for the petitioner submits that the petitioner has filed this petition aggrieved by order of transfer by which he has been transferred at the fag end of his service as he is due for retirement on 31/01/2017. Considering the aforesaid submission and that the case has come up for hearing on the date of retirement of the petitioner, at this stage, this petition can be disposed off with a direction that now, impugned order in respect of the petitioner shall not be given effect to against him. The respondents shall pass appropriate corrective order so that the petitioner shall be treated as having retired from Tahsil - Gourela, District - Bilaspur.
This petition is accordingly finally disposed off. A copy of this order shall be submitted by the petitioner before the competent authority also so that there may not be any difficulty in the matter of settlement of pension of the petitioner.
