Heard on application under Section 439 of the Code of Criminal Procedure.

Learned counsel for the applicant submits that the applicant has been arrested in connection with Crime No. 31 of 2016 registered at Police Station - Udaypur, District Sarguja, Chhattigarh for the offence punishable under Sections 406, 420, 467, 468, 471, 120-B and 411 of the Indian Penal Code. He further submits that the applicant is son of Mr. Abrar Ahmad whereas accused in this case is another person named similarly but the father of that person is Anwar Firdousi. The applicant has been falsely implicated. Hence, it is prayed that he may be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application and the submissions made in this respect. 4.

Heard learned counsel for the parties and perused the case diary. 5.

As per the case diary and the material on the basis of the prosecution has been lodged, it appears that the accused named Sohrab Firdousi S/o Anwar Firdousi is the accused against whom witnesses have made allegations and given statements. Considering the facts and circumstances of the case and also the report in case diary that there is no criminal history of the applicant, this appears to be a fit case in which the applicant should be enlarged on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
