This is second bail application under section 439 of Cr.P.C. The earlier bail application was dismissed as withdrawn on 20/04/2018 vide MCRC No.1469 of 2018.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.456/2014 registered in Police Station City Kotwali, Mungeli, District Mungeli (C.G.) for offence punishable under sections 420, 467, 468, 471, 34 of IPC. 3.
As per the prosecution case, the applicant alongwith co-accused prepared false entry sheet, debit slip and document after hacking the ID and password on the basis of false bill obtained from the CSPDCL. 4.
Learned counsel for the applicant submits that trial against one of the co-accused came to an end on 20/03/2018 wherein he was acquitted of the charges, therefore no offence is made out against the applicant and he may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

As appears the applicant was absconding. He has been arrested on 21/12/2017. Considering the fact that he was absconding for considerable period and granting bail to the applicant will defeat very purpose of the principle as he was absconding. Taking into fact that the applicant was arrested on 21/12/2017 which do not show that unreasonable delay has occurred till date. Considering the background of the case, I am not inclined to release the applicant on bail. 7.
