Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 9 / 11 /201 (1) Learned counsel appearing for the parties would submit that issue raised in these writ petitions are covered by judgment of Division Bench of this Court in Writ Appeal No. 67 of 2016 (Chhattisgarh State Civil Supplies Corporation Limited Vs. Udho Prasad Sharma) vide order dated 26.02.2016.
(2) Paragraph 8 of the judgment of the Division Bench states as under:- "8. We therefore modify the judgment under appeal at paragraph-12 only to the extent that the direction quashing the two charge sheets is set aside and it is held that the departmental proceedings against the Respondents have lapsed after superannuation with its attendant consequences in absence of any authority to proceed under the law."
(3) In view of the submissions made by the parties, these writ petitions stand disposed of in terms of paragraph 8 of the judgment of the Division Bench of this Court passed in Writ Appeal No.67 of 2016.
