Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 9 / 11 /201 (1) Learned counsel appearing for the petitioner would submit that departmental enquiry against the petitioner has already been lapsed in light of the order passed by this Court in W.P. (S) No. 2441 of 2013 and, therefore, he may be allowed to make representation before the respondents for payment of gratuity and the same may be directed to be decided expeditiously.

(2) Prayer appears to be fair & reasonable.

(3) Be that as it may, if the petitioner prefers representation before the respondents No. 1 & 2 for payment of gratuity, the respondents

shall decide the petitioner's entitlement for payment of gratuity in accordance with law within a period of 45 days from the date of receipt of copy of this order.

(4) With the aforesaid observations, the writ petition stands finally disposed of.
