1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.182/2019, registered at Police Station - Gandai, District - Rajnandgaon (C.G.) for the offence punishable under Sections 457, 380 read with Section 34, 411 of the Indian Penal Code.

3. The applicant alongwith co-accused Sunil Pardhi and Satish Pardhi have committed theft of jewellery, clothes and mobile from three shops belonging to the complainant Diwakar Soni and the total value of the stolen article is stated to be Rs. 2,84,800/-.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Co-accused Sunil Pardhi and Satish Pardhi have been enlarged on regular bail in MCRC No.3484/2020. This applicant is in jail since 11-11-2019, therefore, considering the entire facts situation of the case, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
