1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.315/2020 registered at Police Station Kotwali, District Bastar for the offence punishable under Section 20(£) of the NDPS Act.

3. The applicant and co-accused Santosh Parihaar were found in joint illicit possession of 21 Kg 240 g of Ganja.

4. Admittedly, co-accused Santosh Parihaar has already been released on regular bail by this Court vide order dated 19.8.2021 passed in MCRC No.4851 of 2021.

5. Learned counsel for the State opposes the bail application. However, he submits that the concerned SHO has not reported any previous criminal antecedents of the present applicant of his involvement in similar nature of offence. He also submits that in the charge sheet, the name of the accused is mentioned as Sanatlal Lilhare S/o Makhan Lal Lilhare, whereas, in the present bail application, the accused/applicant's name is mentioned as Sanatram Lilhare S/o Makhan Lal Lilhare.

6. Considering the release of co-accused on regular bail and for the fact that the present applicant is in jail since 10.7.2020, I am inclined to release the applicant on regular bail.

7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs. One Lakh with one local surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
