Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 21/09/2017 The transfer order is under challenge on the ground that the petitioner having been elected as Office Bearer is entitled to relaxation from transfer as the petitioner has not even completed normal tenure of posting of one year at the transferred place. Taking into consideration that the petitioner has not even completed one year of posting at the transferred place as he is posted at the present place vide order dated 27/09/2016 and under the policy dated 25/08/2004, is exempted from transfer, the matter would require consideration.

The petitioner to submit representation within 15 days and the respondents shall consider and take decision within a period of four weeks from the date of receipt of representation.

For a period of six weeks, no coercive steps shall be taken against the

petitioner.

The petition is finally disposed off.
