D. P. Khare v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 3563 of 2016 • D. P. Khare S/o Late Dayaram Khare, Aged About 46 Years Posted As A R H O (Rural Health Organizer) Sub Health Centre Sirri, Block Gunderdehi, District Balod (Chhattisgarh) ---- Petitioner
Versus
1. State Of Chhattisgarh Through The Secretary, Department Of Health, Mahanadi Bhavan Mantralaya, New Raipur (Chhattisgarh)
2. Collector, Balod District Balod, Chhattisgarh.
3. Chief Medical & Health Officer, Balod District Balod, Chhattisgarh. ---- Respondents --------------------------------------------------------------------------------------------------- For Petitioner :
Mr. B.P. Singh, Advocate For State :
Mr. D.R. Minj, Dy. Government Advocate --------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 16/09/2016 Heard.
1.
The transfer order has been challenged on the ground that the petitioner is transferred to a place namely Harrathema, Block Dondi, whereas there is no such place like Harrathema in Block Dondi. This Court had stayed the transfer order and directed the respondent-State to seek instructions. Now, the respondent-State has come out with corrected order passed on 06.09.2016 by the Chief Medical and Health Officer as directed by the Collector, wherein, it has been mentioned that due to typographical mistake in place of "Balod" name of Block was wrongly typed as "Dondi". 2.
Though, learned counsel of the petitioner submits that this amounts to amendment of the transfer order, which would require the procedure of co-ordination to be followed, I am not inclined to
accept the submission because, it is not a case of amendment of place of posting, in the sense, that now the place of transfer of the petitioner has been changed. The petitioner has been sent to Harrathema. The only mistake with regard to the name of Block where Harrathema is situated has now been corrected. Therefore, I am not inclined to interfere with the transfer order. The petition is accordingly dismissed and stay granted earlier is vacated. Sd/- (Manindra Mohan Shrivastava) Judge Chandra
