1. Learned counsel appearing for the petitioner, on instructions, would submit that the petitioner may be permitted to withdraw this petition under Article 227 of the Constitution of India with liberty to move appropriate application before the trial Court for withdrawal of the suit with liberty to prefer duly constituted suit/proceedings afresh under the provisions of the Chhattisgarh Rent Control Act, 2011 for eviction of the respondent from the suit premises.

2. No objection from other side.

3. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberties.
