The applicants have preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as they have been arrested in connection with Crime No.31/2020, registered at Police Station Benur, District Narayanpur (CG), for the offence under Sections 302, 364, 120B & 201 of the Indian Penal Code and Sections 4 & 5 of the Chhattisgarh tonahi Pratadna Nivaran Act.

The main accused Kansai Netam and five other accused persons have allegedly hatched a conspiracy to eliminate the deceased Ramji for the reason that he was practicing sorcery/witchcraft. In the night of 10-6-2020 one unknown person came to the house of the deceased and took him along and thereafter his dead body was found on the road in the next morning.

During investigation, data of mobile sets were collected and it was found that the main accused Kansai Netam, who has been identified during Test Identification Parade (TIP), was in constant contact with the present applicants and other accused persons. Except for this evidence, there is no other evidence e.g. last seen together, extra judicial confession, seizure of incriminating articles, etc. from these applicants. 5.

Considering the entire facts situation of the case; further considering the quality of evidence; as also for the fact that the applicants are in jail since 21-10-2020, I am of the opinion that present is a fit case to release the applicants on regular bail.

Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
