Heard on I.A. No.1/2021, an application for grant of interim bail.

The applicant is arrested in connection with Crime No.142 of 2018 registered at police station Kota (Kargiroad), District- Bilaspur, Chhattisgarh for the offence under Section 363, 366 and 376, 34 of Indian Penal Code, Section 6 of the Protection of Children from Sexual Offences Act, 2012 and Sections 3(1)(b-i)(b-ii) and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is submitted by counsel for the applicant that he does not want to press the 3rd bail application filed for grant of regular bail to the applicant. Learned counsel intends to press only on the application for grant of temporary bail and the application for the same has been filed on 15.7.2021.

It is submitted by counsel for the applicant that the applicant was previously married to Mahendra Giri and she had two children from him. As the applicant left her husband, she has re-married with Parmal Gurjar and her children are in custody of her second husband i.e. Parmal Gurjar, therefore, only for the purpose that she may be able to take the custody of her children from Parmal Gurjar and handover them to their father - Mahendra Giri, therefore, a temporary bail of 20 days only be granted to her.

Learned counsel for the State/respondent has objection on this application.

After considering the submissions, only for the purpose of welfare of the children of the applicant with her first husband, this application for interim bail is allowed. It is directed that applicant shall be released on temporary basis on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court for a period of 20 days. The applicant shall surrender before the concerned Court on the 21st day from the date she is released on bail by the Court concerned. Accordingly, this M.Cr.C. is disposed off.
