Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.237/2020 registered in Police Station Kawardha, District Kabirdham for offence under Section 420, 467, 468, 471, 34 of the IPC.

2. The present applicant along with 7 other co-accused persons have allegedly committed fraud, cheating, concoction of documents etc. in connection with loan transaction with HDFC Bank.

3. Although this applicant is the king pin of the entire operation, as it was he who produced forged revenue papers to obtain the loan, the fact remains that the offences are triable by the Judicial Magistrate 1st Class

MCRC No. 4378 of 2021 and the applicant is in jail since 10.6.2021 i.e. for about 21⁄2 months.

4. Considering the entire fact situation of the case, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
