1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.198/2020, registered at Police Station - Gariaband, DistrictGariaband (C.G.) for the offence punishable under Sections 294, 509(B) of the Indian Penal Code and Section 67 A of the I.T. Act.

3. The applicant has allegedly sent obscene video clips in the mobile phone of sister of the informant.

4. Learned State counsel would oppose the prayer for grant of bail.

5. The applicant has been arrested on 07-12-2020; charge sheet has already been filed and the offences are triable by Judicial Magistrate First Class, therefore, considering all relevant aspects of the matter, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
