Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 20/12/2016 The transfer order is under challenge on the ground that it is without any administrative exigency and even the place of posting of the petitioner has been wrongly mentioned as Bonda whereas the petitioner was already transferred from Bonda to Lailunga on 15/07/2014, in compliance of which, petitioner joined at Lailunga and at the time of passing of the impugned order, he was actually working at Lailunga.

Learned State counsel submits that there is a typographical mistake in mentioning the name of place of posting of the petitioner. 3.

Though it has been stated by the State counsel that there is typographical mistake, there is no order of the State Government modifying or correcting the

transfer order. Therefore, the order, as it stands in respect of the petitioner, cannot be given effect to. It would be for the Government to take decision regarding posting of the petitioner at Lailunga should be changed or not. It would be open for the competent authority to change the transfer order or post some other officer at Lailunga, subject to administrative exigency. 4.

This petition is accordingly disposed off with a direction that until some other order is passed in respect of the petitioner, the impugned order in respect of the petitioner shall not be given effect to.
