Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 15/02/2017 Heard.

1. The petitioner has challenged the transfer order mainly on the ground that the petitioner has been subjected to frequent transfers within a period of 50 days of his joining.

2. This Court had protected the petitioner by an interim order.

3. Respondent-State has filed its reply along with which, a letter dated 16.9.2016 of the District Education Officer, Ambikapur, addressed to the Director, Public Instructions has been annexed which shows that the transfer order of the petitioner was wrongly issued and there is a proposal for modification.

4. In view of the aforesaid development, it is not necessary for this Court to keep the matter pending and it is, therefore, finally disposed off with a direction that the respondents may proceed to pass appropriate modification order. In view of

-2the proposal made for modification, the petitioner shall be allowed to continue till appropriate orders are passed.
