Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :
1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.45/2021 registered in Police Station : Gol Bazaar, District Raipur for offence under Section 294, 323, 327, 506, 307/34 of the IPC and Sections 25 & 27 of the Arms Act.
2. The applicant along with co-accused Ajay Deep @ Samir and Aman Langote have inflicted penetrating wound by means of knife over thigh, left back and left knee.
3. It is argued that the offence under Section 307 of the IPC has been added later on and the injured remained in the hospital only for one day,
MCRC No. 4488 of 2021 therefore, the injuries are not so serious to attract the offence under Section 307 of the IPC.
4. Learned State Counsel would object to the prayer for grant of bail on submission that the applicant has previous criminal antecedent of his involvement for offence under Sections 294, 323 and 324 of the IPC.
5. Considering the entire fact situation of the case and for the fact that the applicant is in jail since 11.6.2021, I am inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
