Mahipal Ram @ Mahto Kawnr v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR MCRC No. 6239 of 2017 Mahipal Ram @ Mahto Kawnr S/o Mahabir Ram Aged About 31 Years R/o Village Natwar Nagar Police Station Kusmi, District Balrampur Ramanujganj, Chhattisgarh ---- Applicant
Versus
State Of Chhattisgarh Through Police Station Kusmi, District Balrampur Ramanujganj, Chhattisgarh ---- Respondent Shri Pramod Shrivastava, counsel for the applicant/s. Shri Chandresh Shrivastava, Panel Lawyer for the State. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/10/2017 This application for grant of bail is filed on the submission that the trial has not been concluded even after one year and about 17 witnesses are yet to be examined.
On the other hand, learned State counsel submits that as the offence is punishable with a minimum sentence of three years, the application is liable to be rejected.
The trial has remained pending for the last more than one year without conclusion. However, considering that the applicant is alleged to have committed offence under Section 354 (B) of IPC, at this stage, I am not inclined to grant bail to the applicant. In case, trial is not concluded within a further period of three months, the applicant would be at liberty to revive this application. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
