This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicant has been arrested in connection with Crime No.54/2019 registered at Police Station- P.S. Sariya, District Raigarh (C.G.) for the offence punishable under Sections 34 (2) & 59(A) of CG Excise Act. 3.
Argument heard.

Case of the prosecution, in brief is that on 10.04.2019, 40 bulk liters of hand made country liquor has been seized from the possession of the applicant. 5.
Counsel for the State submits that one another criminal case under Excise Act has been registered against the applicant. 6.
Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- along with a personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned, he be released on bail. 7.
