1. Learned counsel for the appellant at the outset, seeks to withdraw the appeal on the submission that since co-accused have been granted regular bail, the appellant also intends to cooperate with the investigation, surrender and apply for regular bail. He would submit that the Court below may be directed to consider his application for regular bail at the earliest.

2. Considering the submission of learned counsel for the parties, the appeal is dismissed as withdraw, however, it will be open for the

appellant to surrender and apply for grant of regular bail before the Court below.
