The transfer order has been challenged on the ground that the petitioner is going to retire within less than one year from the date when the transfer order has been issued.

In the transfer policy dated 11.06.2016 it has been provided in clause 2.10 that those Government servant who are going to retire within less than one year shall be considered for being transferred at their home district or at place of their option. 3.
Considering that the petitioner is going to retire in the month of June, 2017, matter requires consideration.

In this case, it is found that petition is filed without filing any representation, therefore, in this situation the only direction that
can be issued is that if the petitioner submits representation before competent transferring authority within 10 days from today, the same shall be considered and decided preferably within a period of four weeks. For the next five weeks, coercive steps shall not be taken against the petitioner.
