Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 29/08/2016 Learned counsel for the petitioner would submit that initially, the petitioner was appointed in Nagar Panchayat, Dongargaon. On account of his transfer to Nagar Palika Parishad, the petitioner has lost opportunity of promotion at his original place of posting.

According to the petitioner, earlier, when the petitioner approached this Court, an order was passed on 05/08/2016 in WPS. No.2556/016 for consideration of petitioner's case for promotion. Petitioner's apprehension is that the present transfer order would affect the promotion of the petitioner. 3.

In view of submission made by learned counsel for the petitioner, this

petition is presently disposed off with a direction that in the event petitioner moves representation before the competent authority within a period of two weeks from today, the concerned authority shall consider and decide the representation within a period of three weeks from the date of receipt of representation. 4.

Learned counsel for the petitioner submits that till that time, he may be protected in the same manner as ordered by this Court in WP(S) No.3238/2013 (Ajay Kumar Verma v. State of Chhattisgarh and anr.) vide order dated 03/10/2013 which was also an identical case.

Learned counsel appearing for the State and Municipal Council, Dongargaon submit that in view of order of the State Government, the petitioner has been relieved on 22/08/2016.

Till the representation of the petitioner is decided, no coercive steps shall be taken against the petitioner to join at the new place of posting. 7.
