1. Aggrieved by the decision of the respondents whereby the petitioner has been declared ineligible for appointment to the post of Lecturer (Commerce) the present writ petition has been filed.

2. Perusal of the record would show that the advertisement prescribed the minimum eligibility criteria for the said post being M.Com with minimum 55% of marks which in other words means since the appointment was for the post of Lecturer (Commerce), the petitioner should have done or a candidate should have Masters degree in Commerce. The petitioner in the instant case admittedly has not done

Masters degree in Commerce i.e. he is not M.Com qualified. The petitioner has done MBA course i.e. Master of Business Administration. The petitioner makes his claim on the ground that he has studied most of the subjects which are otherwise studied or which are also prescribed under Commerce course.

3. After arguing for sometime, counsel for the petitioner submits that let the writ petition be disposed of directing the respondents to consider and decide his representation which the petitioner has made so far as his qualification part is concerned.

4. Without expressing any opinion on the merits of the case the writ petition at this juncture stands disposed of directing the respondents to consider the representation of the petitioner on its own merits strictly in accordance with the rules and regulations governing the field at the earliest, preferably within a period of 90 days from the date of receipt of a copy of this order.
