Hon'ble Shri Justice P. Sam Koshy Order on Board 05/07/2021
1. The present MCC has been filed by Applicants/Respondents seeking for extension of time for compliance of the Order dated 19.3.2021 passed by this Court in WPS No.1149/2021.
2. The aforesaid Order passed by this Court was to consider and decide the claim application of Non-applicant/Petitioner for dependant employment within a period of 90 days.
3. Learned Counsel for Applicants/Respondents submits that the Order was on 19.3.2021. However, because of Covid-19 impact followed by lockdown prevailing for a considerable period of time, no proceedings as such could be drawn towards the compliance of the Order. Immediately after the situation got improved, a correspondence was made to the Non-applicant/Petitioner on 11.5.2021 calling upon certain documents which the mother of NonApplicant/Petitioner has forwarded only on 5.6.2021 and now those documents are put up for verification and it would take some further time for the
compliance of the directions given by this Court and thus the prayer for extension of time.
4. Learned Counsel for Non-applicant/Petitioner has no objection in this regard.
5. Given the entire facts and circumstances and also taking note of the submissions made by learned Counsel for Applicants that the management of SECL has already in the process of considering the claim of Nonapplicant/Petitioner and they have ordered for verification of the documents submitted on the part of the Petitioner/Non-applicant, ends of justice would meet if the Applicants are granted a further 90 days time for compliance of the Order dated 19.3.2021 passed in WPS No.1149/2021 in its letter and spirit. It is accordingly ordered so.
6. Let a copy of this Order be kept in the record of the original Writ Petition i.e. WPs No.1149.2021.
7. MCC stands allowed and disposed of accordingly. Sd/- (P. Sam Koshy) JUDGE sharad
