The applicant has been arrested in connection with Crime No.285/2017 registered at Police Station - Sirgitti, District - Bilaspur (CG) for alleged commission of offences under Section 366, 354 of IPC.

Case of the prosecution is that the applicant kidnapped and taken away the prosecutrix who is mentally retarded and outraged her modesty by removing her entire clothes.

This Court perused the case diary. The statement under Section 164 CrPC of the mother of the prosecutrix shows that the prosecutrix, who is a mentally retarded girl, was found with the present applicant in an abandoned building and the applicant had completely removed her clothes and about to rape the girl. 4.
