The transfer order is under challenge on the ground that the petitioner is an office bearer of District Level elected on 22.12.2014.
-2Therefore, as per Government transfer policy, being an officer bearer, the petitioner is exempted from transfer for a period of 3 years. The certificate dated 22.12.2014 has been issued by the District Level President of the Association. The petitioner has been appointed as President of Women Cell. Therefore, she cannot be said to be the President of the Association at the district level. Therefore, the benefit of circular dated 24.06.1998 is not available to the petitioner. The petitioner has already completed normal tenure of service, therefore, the petitioner could be transferred in exigency of service. The petition has no merit and is therefore dismissed.
