Mr. Ashwani Shukla, Counsel who represents the Office of Accountant General submits that under the present procedure prescribed for disposal of applications by the Retiral Dues Committee, the matter is required to be dealt with by the Committee but the petitioner has not submitted the copy of the order and application before the committee which was informed to the Office of Accountant General vide memo dated 01.12.2017 of the General Administration Department of Government of Chhattisgarh.

There is note-sheet prepared in the Office of Municipal Corporation, Durg which wrongly records that case has been dismissed. 3.

Shri Satish Gupta, Advocate who represented the Municipal Corporation in

the writ petition states that he would be properly advising the Corporation in the matter to extend all cooperation to the Retiral Dues Committee in the matter for consideration and disposal of petitioner's claim of dues. 4.

In view of the aforesaid circumstances and statement made in the case, I am not inclined to proceed further in the matter. The contempt petition is closed. 5.

A copy of this order shall be submitted by the petitioner along with earlier order passed by this Court on 22.09.2016 in WPS No.5022 of 2016 before the competent authority as directed therein as also before the Commissioner, Municipal Corporation, Durg. A copy of petition may be supplied to learned counsel for the parties as also Shri Satish Gupta, Standing Counsel for Municipal Corporation, Durg on payment of necessary charges.
