Versus
1.
State of Chhattisgarh, Through its Secretary, Deptt. of Health & Family Welfare Mantralaya, Naya Raipur.
2.
Director, Medical Education Old Nurses Hostel, DKS Bhawan, Parisar, Raipur. ---- Respondents For Petitioner :
Shri Raja Sharma, Advocate.
For Respondents/State :
Shri Prafull N Bharat, Additional Advocate General. Hon'ble Shri Navin Sinha, Chief Justice Hon'ble Shri P. Sam Koshy, J.
Order on Board Per Navin Sinha, Chief Justice 16/09/2015 1.
The Petitioner was a candidate for the Chhattisgarh Pre-Medical Test 2015 in the general category. Pursuant to the first round of counselling, she was offered a seat in the Government Medical College, Rajnandgaon. Similar was her fate when she went in second round of counselling and it has remained the same in the third round of counselling also. 2.
Learned Counsel for the Petitioner submits that she is willing to forego the benefit of the third round of counselling at her own risk and consequences with regard to State quota seats which may have remained unfilled for any reason or that may revert to the State quota from the Central quota. 3.
Learned Additional Advocate General emphasises that this has to be at the entire risk of the candidate herself but fairly submits that he has instructions that if the candidate does not opt for either of the two options as indicated in the acceptance/rejection process, the candidate would be
considered for unfilled State quota seats or the seats that may revert to the State Quota from the Central quota.

The writ petition is disposed in the aforesaid terms. Sd/- Sd/- (Navin Sinha) (P. Sam Koshy) CHIEF JUSTICE JUDGE Amit
