The petitioner in the present writ petition has a grievance with the respondents of not settling the dues which the petitioner was entitled for on his retirement.

According to the petitioner, he stood retired from service w.e.f. 31.12.2016 and till date the respondents have not released the family welfare fund, which he was entitled for. It is further contended that the petitioner also was entitled for the benefits of the 7th pay commission recommendation which was given effect to from 01.01.2016 onwards, and which the petitioner was entitled for the whole year as he retired from service only on 31.12.2016.

Given the limited grievance that the petitioner has, this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending, rather ends of justice would meet if the respondents No.2 & 3 are directed to consider the claim of the petitioner so far as non-releasing of the arrears of salary as per the recommendations made by the 7th pay commission for the period between 01.01.2016 to 31.12.2016 and also consider granting of the family welfare fund, which the petitioner was entitled for on his retirement.

Let the respondents No.2 & 3 take a decision in this regard within a period of 4 months from the date of receipt of the copy of this order. 5.

It is made clear that in case if the petitioner is found entitled for these dues on his retirement and which has till date not been paid, the same should be released within the aforesaid period of 4 months, failing which the said amount shall carry interest @ 10% p.a. from the date of retirement till the date of actual payment is made.

It shall be the responsibility of the petitioner to apprise the respondents No.2 & 3, so far as the order passed by this Court is concerned. 7.

With the aforesaid observations, the present writ petition stands disposed off.
