This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and no other bail application is pending before any other Court.

Perused the case diary provided by the learned counsel for the State in connection with Crime No.495/2018 registered at Police Station- Pandri, District- Raipur (C.G.) for the offence punishable under Sections 420, 467, 468, 471 of Indian Penal Code.

Case of the prosecution, in brief is that applicant on the pretext of providing job in CSPGCL to the complainant took Rs.2,70,000/- and providing them forged appointment letter.

Learned counsel for the applicant submits that applicant is innocent person and he has falsely been implicated in the crime in question. He further submits that the applicant is in custody since 26.11.2018, therefore, the applicant may be released on bail.

On the other hand, learned State counsel opposes the bail application. 6.

Taking into consideration the nature and gravity of the offence, facts & circumstances of the case, and further considering the fact that the applicant is in custody since 26.11.2018 and the trial is likely to take some time for its final disposal, this Court is of the view that it is a fit case to release the applicant on bail. Accordingly, the application is allowed.

Accused/applicant is directed to be released on bail on his executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given to him by the said Court.
