Ghanshyam @ Baba Jaiswal S/o Amar Nath Aged About 26 Years R/o- Village Sakreli, P.S. Baradwar, District- Janjgir-Champa, Chhattisgarh., District : Janjgir-Champa, Chhattisgarh ---- Respondent For State/Petitioner :

Shri Praveen Shrivastava, Panel Lawyer D.B. :Hon'ble Shri Justice Manindra Mohan Shrivastava & Ho n'ble Smt. Justice Vimla Singh Kapoor Order On Board 25/01/2021 Heard.

1. Even if we were inclined to condone the delay in filing the appeal, we do not find any merit in the petition for grant of leave to appeal because the trial Court has granted acquittal giving benefit of doubt to the accused mainly taking into consideration that the accused and the prosecutrix both are major and they had been in longstanding affair of about 5 years which included sexual relation also and the FIR was lodged when the affair could not materialize into marriage.

2. Therefore, the view taken by the learned trial Court does not suffer from any patent illegality or perversity warranting interference against judgment of acquittal.

3. The petition (Cr.M.P.) is accordingly dismissed. Sd/- Sd/-/- -- (Manindra Mohan Shrivastava) (Vimla Singh Kapoor)
