First bail application was dismissed as withdrawn.

Case of the prosecution is that the applicant being the uncle of the minor girl, committed rape on her.

Learned counsel for the applicant submits that the allegations are false. He submits that number of prosecution witnesses including the prosecutrix herself has been examined and in her examination, she has not supported the case of the prosecution by making such statement that she is not being subjected to rape. 4.
On the other hand, learned State counsel submits that the applicant is being tried for commission of heinous offence of rape of her minor niece and the trial is not complete and the statement of the prosecutrix shows that the applicant is tampering with the prosecution witnesses.

Having considered the submission of learned counsel for the parties, no case is made out for grant of bail. The application is therefore rejected. The Trial Court is
