1. The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.305/2021 registered in Police Station Basna, Police Chowki Bhanwarpur, District Mahasamund C.G. for the offence punishable under Section 34(2) of the C.G. Excise Act.

2. Applicant was found in illicit possession of 45 bulk liters of

MCRC No. 4395 of 2021 country made liquor. That apart he has three more cases involving offence under the C.G. Excise Act.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the previous criminal antecedent of applicant, I am not inclined to release him on bail at this stage.

5. Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to revive the prayer after two months.
