Hon'ble Shri Justice P. Sam Koshy Order on Board 22/11/2017

1. The present is a repeat anticipatory bail application filed under Section 438 of Cr.P.C. seeking for anticipatory bail to the applicant apprehending his arrest in connection with Crime No. 83/2017 registered at Police Station Bagbahar, District Jashpur, Chhattisgarh for the offence punishable under Sections 420, 120B, 467, 468 & 471 of I.P.C. The earlier bail application stood withdrawn by the applicant on 03.10.2017.

2. The allegation against the present applicant is that the present applicant being the Branch Manager of Central Bank of India at Branch Bagbahar, District Jashpur in connivance with the other accused persons is said to have released KCC Loan to one Nanki Raut on submission of fake document projecting the Nanki Raut as Dilsai Naag.

-23. The complainant in the instant case Dilsai Naag on receiving a notice for recovery of loan made a complaint to the police authorities of not having applied for loan or obtained loan from the said Bank at all. On verification it was found that the present applicant and the coaccused persons had connived and got illegally the loan released in favour of Nanki Ram Raut.

4. The aforesaid factual matrix of the case prima facie shows the involvement of the applicant and in the given facts and circumstances of the case, this Court does not find it a fit case for grant of anticipatory bail.

5. Accordingly, the present anticipatory bail application stands rejected. Sd/- (P. Sam Koshy) Judge Ved
