Aggrieved by the action on the part of the respondents in not granting the benefits of 7th pay commission to the petitioner w.e.f. 01.01.2016 the present writ petition has been filed. 2.

According to the petitioner, it is a case where the petitioner was initially appointed as a daily wage employee and down the line the services of the petitioner was regularized by the Department vide order dated 05.12.2013 (Annexure P/1). According to the petitioner, though the petitioner has been regularized from 05.12.2013 and he continues in the services of the respondents till date, however when

the 7th pay commission was introduced in the Department w.e.f. 01.01.2016, the petitioner till date has not been granted the benefits of the said 7th pay commission. The petitioner drew the attention of the Court to the inter-department correspondence made between the office of the respondents No.3 & 4 to the respondent No.5 in this regard however, there seems to be no further progress on the same.

The learned counsel appearing for the State on perusal of the interdepartmental records submits that since the matter is already under consideration before the authorities, let the writ petition be disposed of directing the authorities to take a decision purely in accordance with the rules and regulations governing the field. 4.

Given the said submissions made by the counsel for the parties, the writ petition at this juncture stands disposed of directing the respondents No.2 to 5 to take an early decision so far as the claim of the petitioner for grant of the benefits of the 7th pay commission. The respondents are also directed to take into consideration the claim of the petitioner from 01.01.2016 onwards, which includes the arrears of the same. Let an appropriate decision be taken in this regard at the earliest preferably within a period of 60 days from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed off.
