Hon'ble Shri Justice Pritinker Diwaker Order On Board 30/09/2015 Petitioner who is working as Pharmacist Grade II has assailed her transfer order dated 20.7.2015 passed by respondent No.3 whereby she has been transferred from Primary Health Centre Labhandi to Primary Health Centre Silyari.

Counsel for the petitioner submits that recently the petitioner had delivered a child and it would be difficult for her to go and join at the transferred place. He further submits that husband of the petitioner is employed in Bank and is posted at Jagdalpur and the order impugned would cause numerous problems to the family. He submits that purpose of filing this petition would be served if at this stage the petitioner is permitted to withdraw this petition with liberty to file representation before the Commissioner.

However direction may be issued to the Commissioner for deciding the representation so made, expeditiously.

State counsel has no objection to the above proposition as put forth by the petitioner. He however submits that the representation of the petitioner would be decided in accordance with law.

Accordingly the petitioner is permitted to withdraw this petition. In the eventuality of filing any such representation by the petitioner within a period of two weeks from today it is expected from the Commissioner to decide the same within a further period of four weeks from the date of receipt of the said representation.

No observation on the merits of the case has been made by this Court and the competent authority shall be at liberty to act in accordance with law. Sd/- Pritinker Diwaker Judge suguna
