Learned counsel for the State submits that in view of order dated 08.3.2021 passed by the Apex Court in the Suo Moto WPC No.03/2020, instant CrMP is within the period of limitation. Therefore, he does not want to press application for condonation of delay in filing the CrMP.

In view of the above submission, application for condonation of delay in filing the CrMP is dismissed as not pressed. Also heard on application for grant of leave to appeal under Section 378(3) of the CrPC.

On due consideration, leave is granted.

Let the CrMP be registered as Acquittal Appeal. Also heard on admission of the acquittal appeal. On payment of PF as per rules, issue notice to the respondent. Notice be made returnable within six weeks.

Call for the record of the court below.
