Hon'ble Shri Justice Goutam Bhaduri Order 21/07/2020 Heard.

1. The nature of reliefs claimed needs to be adjudicated after evidence is adduced as inter succession rival claim has been made by the petitioner on the basis of the right conferred by the Succession Court. Therefore, this Court under Article 226 cannot record the evidence of the parties to decide the right of the petitioner namely Smt. Mandavi Singh, further the entitlement and apportionment of claim needs to be proved before the competent court

having the jurisdiction. This Court can not act as a Court of Succession and interpret the earlier order passed by the Court below.

2. In view of this, the petition is devoid of all merits and accordingly stands dismissed, however, the petitioner shall have the liberty to approach the competent Court if so advised.
