The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 21.05.2021 in connection with Crime No. 174/2021 registered in Police Station- Thana Gourella, District GourellaPendra-Marwahi (CG) for the offence punishable under Sections 457 & 380 read with Section 34 of IPC.

2. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

3. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
