Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 24/10/2016 This petition has been filed against transfer order mainly on the ground of personal difficulty that the petitioner's daughter is suffering from paralytic effect and she is receiving treatment from nearby place. 2.

The petitioner has preferred representation on 04/08/2016. The representation does not show any receipt. Therefore, considering the aforesaid ground, the petitioner shall submit her daughter for examination before the Chief Medical and Health Officer or such other officer, as may be directed by the Chief Medical and Health Officer (CMHO) for proper examination and with the report, the petitioner shall submit representation to the State Government. The examination shall be conducted by the CMHO, Surguja or the competent medical officer within a period of one week from the date, she appears before CMHO.

Thereafter, appropriate certificate may be issued. The petitioner shall submit representation within a period of one week from the date of receipt of the certificate. Thereafter, decision shall be taken by the respondents within a period of four weeks from the date of receipt of representation. 3.

For a period of six weeks, coercive steps shall not be taken against the petitioner and if no-one has joined at the place of the petitioner, the petitioner shall be continued at the present place of posting till her representation is decided.
